This policy governs the use of the Broreps.fr site and the terms and conditions associated with its digital services. By accessing the site, you fully and unreservedly accept the conditions below.
Article 1 – Conditions of use of the site
The user must be of legal age according to the legislation of their country, or use the site under the supervision of a legal representative. Any fraudulent, abusive or manifestly contrary to law use may result in the suspension or removal of access to the services, at the sole discretion of Broreps.fr.
Article 2 – Access to services and general conditions
Broreps.fr may refuse access to the site or its services at any time for legitimate reasons. With the exception of payments, exchanges on the site may be unencrypted. Any reproduction or reuse of the content without authorization is prohibited.
Article 3 – Accuracy of information
The content available on the site is provided for information purposes only. Despite our vigilance, we do not guarantee their complete accuracy. It is up to the user to cross-reference them with other sources.
Article 4 – Modification of services and prices
Offers, prices and content may be changed or deleted without notice. Broreps.fr declines all responsibility for the consequences of these changes.

Our services are exclusively digital and available online. Broreps.fr may limit their access to certain geographic areas.
Article 6 – Customer data
The user is responsible for the accuracy of the information provided. In the event of doubt or obvious error, Broreps.fr may refuse or cancel the order.
Article 7 – Use of third-party tools
Some features rely on external tools, including apps integrated through Shopify. Their use is at the user's risk. Broreps.fr declines all responsibility in the event of a bug, incompatibility or failure.
Article 8 – External links
Broreps.fr may contain redirects to other sites. We are not responsible for their content or their practices.
Article 9 – Content shared by users
Any content transmitted to Broreps.fr becomes its property without obligation of confidentiality or compensation. The user certifies having the necessary rights.
Article 10 – Personal data (GDPR)
Data processing is governed by our Privacy Policy, in compliance with the GDPR. In accordance with the Data Protection Act and the General Data Protection Regulation (GDPR), each user has the following rights:

Personal data is kept for the duration necessary for the execution of the service, then archived for 5 years for legal, tax or evidentiary purposes.
Some technical data (such as Shopify logs) may be anonymized for statistical purposes.
No resale of data is carried out.
Cookies are used to improve the user experience and ensure the functionality of the site. You can manage them through your browser settings.
Article 11 – Errors and updates
Broreps.fr reserves the right to correct any error or omission at any time, without notice.
Article 12 – Prohibited uses
It is prohibited to use the site for expressly illicit, defamatory or harmful purposes. In the event of suspicious or harmful behavior, Broreps.fr reserves the right to limit, suspend or terminate access to its services, without notice.
Article 13 – Publication of reviews and reputation
If a customer publishes false reviews or publicly attacks Broreps.fr without having attempted prior resolution via customer service, Broreps.fr reserves the right to suspend their account and take legal action.
Article 14 – Limitations and absence of guarantee
Use of the site is at the user’s own risk. No guarantee is given on the availability, compatibility or reliability of the services.
Article 15 – Liability
Broreps.fr cannot be held responsible for direct or indirect damage linked to the use or inability to use the site or its services.
Article 16 – Compensation
The user undertakes to cover Broreps.fr against any claim or dispute resulting from non-compliant use of the site, including in the event of violation of third party rights or applicable regulations.
Article 17 – Severability clause
If any provision of this policy is found to be invalid, the others will continue to apply in full force.
Article 18 – Broreps subscription conditions
Packages available: monthly (min. 2 months) or weekly (min. 2 weeks)
Automatic renewal
Payment by direct debit (CB or SEPA)
Termination possible after the commitment period, with 7 days’ notice
No guarantee of results; the subscriber is responsible for the content broadcast
In the event of force majeure, neither party will be held responsible
Article 19 – Subscription termination policy
Any request for termination must be made in writing via the contact form or by email to contact@broreps.fr.
It will take effect at the end of the current subscription cycle, subject to compliance with the notice period mentioned in article 18.
No early termination gives right to a refund, except for a serious breach or manifest error by Broreps.fr.
Additional purchase options linked to a subscription (boosts, packs, modules) are also non-refundable as soon as they are activated or delivered, even partially.
Article 20 – Competent court
In the event of a dispute, the competent courts will be those within the jurisdiction of the head office of Broreps.fr, unless otherwise required by law.
Article 21 – Entirety of the document
This policy supersedes any previous version. In the event of translation, only the French version is authentic.
Article 22 – Acceptance of conditions
Any order placed on the site Broreps.fr implies full and complete acceptance of these General Conditions of Use and Sale (CGUV).
In accordance with article 1119 of the Civil Code, the general conditions validly brought to the attention of the customer are binding on him, unless otherwise agreed in writing between the parties.
User engagement
By validating their order, the user acknowledges having read the General Terms and Conditions, accessible at any time on the site, and undertakes to respect them without reservation. This acceptance constitutes express consent, in accordance with article 1127-2 of the Civil Code (formation of the electronic contract).
Preservation of evidence
In accordance with article 1366 of the Civil Code (electronic written proof), Shopify and our service providers keep time-stamped technical logs relating to each order. These elements may be produced in the event of a dispute and are authentic between the parties, unless proven otherwise.
Article 23 – Purchase options cancellation policy
Purchase options (boosts, packs, additional or personalized services) are firm and final once ordered.
No cancellation can be taken into account after validation, except in the event of an obvious technical failure.
As soon as a boost, pack or service is activated (even partially), it is considered delivered and non-refundable.
Article 24 – Limits linked to partner platforms
Broreps.fr declines all responsibility in the event of modification of algorithms, internal policies or technical limitations of third-party platforms (TikTok, Instagram, etc.) which may impact the services purchased.
Article 25 – Incorrect data provided by the customer
In the event of provision of incorrect data (invalid pseudonym, broken link, blocked access, etc.), Broreps.fr reserves the right to suspend execution of the order, without obligation to reimburse.
Article 26 – Force Majeure
Neither party may be held responsible for a failure to fulfill its contractual obligations if this failure results from an event of force majeure, as defined by the case law of the French courts.
Are considered in particular as cases of force majeure, without this list being exhaustive :

Natural disasters (floods, fires, storms, earthquakes)

Pandemics or major epidemics

Acts of war, attacks, armed conflicts or riots

Interruptions of telecommunications or third-party hosting networks

External strikes, blockages of postal or transport services

Unforeseen government decisions or administrative injunctions
In the event of force majeure, the execution of obligations is suspended for the duration of the event. If the duration of the impediment exceeds thirty (30) calendar days, either party may terminate the contract without compensation, by written notification.
Article 27 – Testimonials and Opinions Published on the Site
Testimonials presented on the site BroReps.fr are collected, selected and published directly by the BroReps team.
They may include, without this list being exhaustive:
authentic feedback from creators who have used the services,
illustrative examples inspired by typical customer feedback,
or content representative of the general user experience.
These testimonials are not subject to verification by a third party organization and are distributed for informative and inspirational only.
They have no contractual value and in no way constitute a guarantee of results.
Article 28 – Variability of Results and No Guarantee
The services offered by BroReps.fr aim toimprove digital visibility users on social platforms.
The results (subscribers, views, likes, shares, engagement, reach, etc.) may vary depending on numerous factors beyond our control, including:
the algorithms and internal policies of the platforms (TikTok, Instagram, YouTube, etc.),
the quality, frequency and consistency of the content published,
technical updates, server limitations or temporary suspensions,
the activity or seniority of the customer account.
No guarantee of numerical results is given.
The services being performed immediately, no reimbursement or compensation can be required in the event of a variation in performance.
BroReps.fr cannot be held responsible for the effects linked to modifications of algorithms, suspensions, or deletions decided by the platforms.
Article 29 – “Drops Possible Despite Refill” Clause
Some services include a so-called “refill” option.
This option allows, as far as possible, to partially compensate for a reduction observed (subscribers, views, likes).
However:
The refill is neither guaranteed nor unlimited,
He can be refused if the data provided is incorrect or the account becomes private,
He does not amount to a commitment to results,
It is subject to technical limits third-party providers and internal platform policy.
Of natural drops may occur even after the service has been completed.
The customer acknowledges that these fluctuations are an integral part of the functioning of social platforms.
Article 30 – Opinions, Notes and Testimonials
The opinions displayed on BroReps.fr are grouped under the heading “Creator testimonials”.
They represent authentic feedback, illustrative or inspired by real cases, presented for informational purposes only.
They do not in any way constitute a guarantee of performance, nor a contractual commitment.
The ratings displayed (e.g.: “4.8/5*”) include an asterisk specifying:
* Indicative rating based on testimonials collected over a rolling period of 12 months.
Results may vary depending on algorithms, niche and account activity.
BroReps.fr reserves the right to moderate or delete any testimony contrary to the law, defamatory or inconsistent.
Article 31 – Mention relating to the variability of results
BroReps.fr expressly informs its users that the digital visibility services offered are subject to variable results, depending in particular:

of algorithms and internal policies of social platforms,

of the quality, from the frequency and the relevance of published content,

as well as external factors independent of the will of BroReps.fr.
As a result, no guarantee of result or quantified performance is given.
Variations, fluctuations or “drops” may occur at any time, including after the service has been completed, without this being considered a contractual breach.
The customer acknowledges, by validating his order, having been informed of this variability and accepting it. without reservation.
Article 32 – Final acceptance
Validation of any order on BroReps.fr constitutes full acceptance of these General Conditions, including the Articles 28 to 31, relating to the variability of results, possible drops, and the absence of guarantee.
BroReps reserves the right to moderate, adapt or delete any testimony, in particular for reasons of consistency, clarity or compliance with laws and regulations in force.
Article 33 – Non-reimbursement of digital services
The services provided by BroReps.fr are digital services with immediate execution.
In accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply as soon as the service has started with the express agreement of the customer.
As a result, no refund, total or partial, cannot be granted after the start of the service, including in the event of dissatisfaction linked to variations in results or platform updates.
Article 34 – Exclusion of guarantee of results
BroReps.fr acts astechnical intermediary for digital visibility.
The performances obtained (subscribers, views, likes, shares, reach, engagement) are variable and not guaranteed.
No promise of earnings, performance or monetization is made.
Any communication, visual or textual, must be understood as a indicative illustration and not as a contractual guarantee.
Article 35 – Unguaranteed drops and refills
“Drops” (partial losses of subscribers, views or interactions) can occur at any time, regardless of the service delivered.
The “refill” options constitute a simple technical attempt at compensation, without obligation of result.
They can be limited, deferred or refused in case of:
changes to algorithms or platform policies,
account become private, invalid link or URL change,
suspicion of fraud or abusive use of services.
No financial compensation will be due in these situations.
Article 36 – Force majeure and technical failure
BroReps.fr cannot be held responsible in the event of technical failure, software bug, server failure, network incident or malfunction of a third-party provider (hosting provider, payment provider, etc.).
Are considered cases of force majeure :
interruptions of social networks or their APIs,
blockages, restrictions or suspensions decided by the platforms,
major IT outages, attacks or cybersecurity incidents,
administrative decisions, strikes or natural disasters.
The execution of the contract is then suspended for the duration of the event.
No refund or compensation can be requested during this period.
Article 37 – Fraudulent orders and right of unilateral termination
BroReps.fr reserves the right to refuse or cancel any suspicious order (temporary email address, use of stolen cards, payment inconsistencies, etc.).
In the event of proven fraud or a clear attempt to circumvent security systems, BroReps.fr may:
block the account concerned,
suspend access to services,
transmit the necessary information to the competent authorities.
No refund will be made for an order canceled for fraudulent reasons.
Article 38 – Opinions, testimonials and inspired content
The opinions published on BroReps.fr are grouped under the heading “Creator testimonials”.
They may include:
real customer feedback,
content inspired by typical situations,
or illustrative examples for informational purposes.
These testimonies are not not verified by a third party and do not constitute a guarantee of results.
BroReps.fr reserves the right to moderate or remove any opinion contrary to the law, defamatory or inconsistent with the site's policy.
Article 39 – Payment, traceability and proof of execution
Payment is made online by credit card or any other means offered on the site.
All orders are considered accepted upon validation of payment.
Shopify and technical service providers maintain time-stamped logs (logs) and execution proofs to certify the delivery of the service.
These elements are authentic between the parties, unless proven otherwise by the customer.
Any unjustified chargeback attempt may result in a billing of administrative fees and, where applicable, prosecution for fraud.
Article 40 – Dispute procedure and after-sales service response time
In the event of difficulty or dispute, the customer must contact the BroReps.fr After-Sales Service to the address:

The average response time is 48 to 72 working hours.
Each request must contain: the order number, the affected username and one clear description of the problem.
An amicable solution is always sought as a priority.
In the absence of agreement, the dispute will be brought before the competent courts within the jurisdiction of the head office of BroReps.fr, in accordance with Article 20.
Article 41 – Collection and purpose of personal data
BroReps.fr only collects the data strictly necessary for the provision of its digital services.
This information is used for the following purposes:
processing and fulfillment of orders,
management of subscriptions and invoicing,
customer support and follow-up of requests,
fraud prevention and transaction security,
continuous improvement of the user experience.
No data is used for advertising purposes or transmitted to unauthorized third parties.
BroReps.fr acts as data controller within the meaning of Regulation (EU) 2016/679 (GDPR).
Article 42 – Duration of data retention
The personal data collected are kept for limited periods and proportionate to the purpose of the processing:
order data: 5 years (legal accounting and tax obligation),
customer data and after-sales service history: 3 years after the last contact,
technical data (logs, identifiers, pseudonyms): 12 months maximum,
navigation cookies: 13 months maximum.
Beyond these durations, the data is archived or anonymized, then permanently deleted.
Article 43 – Information security and encryption
BroReps.fr implements reasonable technical and organizational measures to protect data against loss, alteration, unauthorized access or disclosure.
These measures include:
SSL/TLS encryption of exchanges on the site,
storage on secure servers certified by Shopify,
restricted access control to customer data,
passwords stored as chopped and salted (not decipherable),
regular audit of access and technical logs.
Since no method offers absolute security, BroReps.fr cannot guarantee total protection against any risk of intrusion.
